Legacy Providers

🚨 Quick Summary

All medical practices must maintain proper signage, postings, and documentation to remain compliant.

Every clinic should ensure:

  • Patient-facing notices are clearly visible
  • Business and licensing documents are current and accessible
  • Staff-related postings are up to date
  • Service-specific signage is in place when applicable

⚠️ Requirements vary by state — California is the baseline for this article, with additional rules outlined below.


📍 CORE REQUIREMENTS (ALL STATES)

These apply across all locations unless otherwise noted.

Patient-Facing (Must Be Visible)

  • Medical Board / Licensing Notice
    • Patients must be informed providers are licensed and how to file complaints
  • Provider Credentials (AB 583 equivalent standard)
    • Clearly visible list of:
      • Provider names
      • License types
      • Degrees
  • HIPAA Notice of Privacy Practices
    • Posted in waiting area
    • Must also be given to patients

Business & Licensing (Keep On File)

  • Business license (city/county)
  • Fictitious name / DBA (if applicable)
  • Medical waste permit (if applicable)

👥 STAFF & LABOR LAW REQUIREMENTS

When Labor Law Posters ARE Required

You must display labor law posters if you have:

  • Any W-2 employees (even just one)

This includes:

  • Front desk staff
  • Medical assistants
  • Nurses
  • Office managers

Required postings include:

  • State + Federal labor law posters
  • OSHA “Job Safety and Health” poster
  • Workplace safety and rights notices

👉 Must be displayed in employee-accessible areas (breakroom, etc.)


When Labor Law Posters Are NOT Required

If you are a solo provider with no employees:

  • Labor law posters are not required

⚠️ Important Nuance

  • 1099 contractors only (no W-2 employees):
    • Typically → posters not required
    • ⚠️ Misclassification risk may still create compliance exposure
  • Shared clinics / med spas:
    • If the facility employs staff, labor law posters should be present on-site
    • Even if you personally do not employ staff

Clinical & Safety Signage

  • Biohazard labeling (required)
  • Infection control signage (handwashing, hygiene)
  • Emergency exit signage

If Applicable to Services

Only required if your clinic offers these:

  • Laser treatments → Laser warning signs
  • X-ray/imaging → Radiation signage
  • Oxygen use → “No Smoking – Oxygen in Use”
  • Medical procedures → Additional disclosures may apply

California has the most comprehensive signage requirements and should be treated as our Legacy standard.

Additional Required Items

  • Open Payments Database Notice (HIGH PRIORITY)
    Must:
    • Be posted in clinic
    • Be provided at initial visit (signed + retained)
    • Be added to website (if applicable)
    • Here is a sample that can be printed and posted
  • Proposition 65 Warning (10+ employees)
    • Must be posted at entrance
  • Detailed Medical Board Notice Requirements
    • Specific formatting + language required

📍 TEXAS

Additional Requirements:

  • Patient rights / treatment disclosure signage (e.g., pain management transparency)
  • Stronger expectation to display facility licensing

📍 FLORIDA (HIGH IMPORTANCE)

Additional Requirements:

  • Human Trafficking Awareness Sign (REQUIRED)
    • Specific format (large font, English + Spanish)
  • Office Surgery Registration Notice (if performing procedures)
  • Controlled Substance Education
    • Must be documented (not always posted)

📍 NEW JERSEY

Additional Requirements:

  • Enhanced patient rights visibility
  • Stronger infection control signage expectations

📍 WASHINGTON

Additional Requirements:

  • State-specific OSHA (L&I) posters
  • Employee injury reporting notices

📍 NORTH CAROLINA

Additional Requirements:
